No- It was a CB Radio with Squelch turned up. MAYBE even a Scanner. 100% LEGAL in most states to have in car.
I still think the driver of the car was using the police scanner to make sure there were no police around at time of impact… or maybe he’s just a regular asian driving O_o

The guy on the scooter is too incompetent to judge the car’s speed. He does glance over his shoulder but apparently can’t tell how fast the approaching vehicle is traveling.
In general it’s hard for me to blame the car driver because plenty of people speed and get away with it. I have a hard time forgiving the scooter guy for just moving over without thoroughly checking.

Actually, I think this is from a country where people drive on the left hand side of the road. All the trucks are in the left two lanes and if you look closely at the area where the scooter pulls out there is a slip road joining from the left and the blue sign reads “Keep Left”.
IMHO that makes it all the scooter rider’s fault. Pulling out without checking mirrors, signalling and (depending on the country) just being in the right hand lane in the first place.

no question. in the law’s eyes, the car should have had enough control to not rear end the scooter. Yes the scooter should’ve looked more carefully, but the car was going too fast. it still would’ve been the car’s fault even if he wasn’t going too fast. even if you pull out in front of someone, it’s the person who rear ended you who is at fault.

This is a common mis-conception of the law, while it is true that if they were in the same lane the driver would be at fault, you must leave enough room to cover every eventuality, generally called the 2 second rule, in this case the scooter rider pulls out in front of the car, without indication, and well within what would be considered the lawful stopping distance for the car (you assume he is speeding, but everyone had just passed an accident so the traffic was slowed, I will admit to he is driving faster then he should be in the circumstances, but he may not have been above the speed limit.)

And was approaching the car (if he was in the passing lane for this country) in the same lane at a much faster speed. If I were to take this case, it would be slam dunk for the cycle rider.

No, it wouldnt. In a typical rear-end accident, driver #1 is stopped when driver #2 hits his car from behind. driver #2 may argue that driver #1 stopped so suddenly it was impossible not to hit him. If so, liability may be split between the drivers, for example, driver #2 may be 70% at fault (comparatively negligent) with driver #1 30% at fault. If you are driver #2 and believe the driver in front was partially responsible for the accident.
As we have the accident on camara the BEST you could hope for would be a 50/50.

The guy on the scooter was trying to get hit. The scooter guy carelessly changed lanes, and then applied his brakes for no reason so the car would hit him.

Are you serious guys??? you do understand that the person the gets rear ended is NEVER at fault. the guy on the scooter in this incident regardless of how he did it is not at fault in anyway because of where he was hit. The person in the outside lane HAS THE RIGHT OF WAY(when entering an express way you yield to the traffic that is to the left of you if you are on a three lane highway and two cars merge from the far left and far right lane and hit the car in the outside lane has right of way or if the car from the center lane merges right they have the right away the only time this is affected is if you come over on top of someone which the guy on the scooter clearly completed his lane change prior to this guys hitting him

How convenient, the scooter goes off onto the side of the road. Now if only the car would pull over it would be a win for everyone else driving correctly.
It is true that the scooter driver was careless. However, you should have control of the front end of your vehicle at all times. Also, the car was clearly speeding. As soon as the car saw the scooter driver look back, he should have reacted accordingly. I’d put blame 75 / 25 fault. car at 75%.

Video was taken in Hong Kong (they drive on the left lane there). Guy has a radio in his car most likely to dodge speed traps. You can hear from the sound of his engine and blow off valve that the guy is driving a sports car.
Yup he was speeding, but the scooter practically switched lanes before he even checked.
